- What is LLC of One?

- How does the IRS treat a single-member LLC by default?
- Per the IRS, for income tax purposes a single-member LLC is treated as an entity disregarded as separate from its owner unless it files Form 8832 and affirmatively elects to be treated as a corporation. What that means for your return is a question for your CPA or enrolled agent.
- Does a single-member LLC need an EIN?
- Per the IRS, a disregarded single-member LLC with no employees and no excise tax liability does not need an EIN. It should use the owner’s name and taxpayer identification number for federal tax purposes. For wages paid after January 1, 2009, the IRS requires the LLC’s own name and EIN for employment taxes. Banks and clients may ask for one anyway; confirm your situation with a professional.
- Should my LLC elect S corporation status?
